McCLINTOCK 1806 Will
Be it
Remembered, That I, Samuel McCLINTOCK of Brandywine Hundred in
the County of NewCastle, being (through Mercy) of sound disposing
Mind and Memory, considering the uncertainty of our Time in this
World, and for the Settlement of what worldly property I am
blessed with, do make and establish this my last Will &
Testament in Manner and Form following, viz;
First, My Will is that all my just Debts & funeral Expenses
be paid as soon as convenient after my Decease out of my Personal
Estate.
Item, I give and devise to my son James McCLINTOCK all that part
of my Plantation whereon he now dwells bounded by lands of Thomas
TALLEY, George CLARK, and my other Lands containing fourteen
acres, be it more of less, together will all and every of the
Buildings and Appurtenances thereunto belonging, which I give to
my said son James during his natural life and at his Decease, to
his son Robert McCLINTOCK, to him, his Heirs and Assigns forever.
I give also to my said son James, during his natural Life, the
yearly sum of twenty-one Dollars to be paid to him as is herein
after directed.
Item, I give and devise to my son John McCLINTOCK to him, his
heirs and Assigns forever all that part of my Plantation
adjoining that above devised to my son James, and divided from
that Part herein devised to my son Samuel by a Line beginning at
a marked White Corner of Land herein devised to my Grand-Son
Samuel, and from thence North forty-five Degrees East
ninety-three Perches to George CLARKs line thirty two
perches from said son James corner, and divided from that
Part herein devised to my Grand-son Samuel, by a line beginning
at the aforesaid White Oak, and from thence south twenty-five
Degrees East ninety-seven Perches to a White Oak in or near
Thomas WEBSTERs Line, and containing fifty acres and three
quarters, be it more of less, together with all and every of the
appurtenances thereunto belonging.
Item, I divide the remaining part of my land by a line running
through the same as follows: Beginning at a Spanish Oak in Samuel
CANBYs line forty Perches from my West Corner, from thence
south eighty and a quarter Degrees, East one hundred and twenty
Perches to a Poplar, thence north fifty-one Degrees east
fifty-eight perches to a Post, thence North sixty-0one degrees,
East fifty-eight perches to a corner White Oak.
Item, I give and devise to my son Samuel McCLINTOCK and to his
Heirs, all that part of my land and Plantation situated on the
North side of the aforesaid Division Line, containing one hundred
and fifty five and a half Acres, be it more or less, together
with all and every of the Buildings and Appurtenances thereunto
belonging, allowing my Clock to be part thereof, he paying out of
the same to his Brother James McCLINTOCK during his natural life
the yearly sum of seven Dollars. But if my said son Samuel should
die without lawful heir of his Body, then and in such case, I
give and devise the said land and premises to my grandson Samuel
McCLINTOCK the son of my son John, to him his heirs and assigns
forever.
Item, I give and devise to my Grand-Son Samuel McCLINTOCK the son
of my son Thomas (decd) all that part of my Land and
Plantation situate on the southerly side of the aforesaid
Division line containing one hundred and fourteen and a half
Acres, be it more or less, together will all and every of the
Buildings and Appurtenances thereunto belonging, to hold to my
said Grand-son Samuel, his Heirs and Assigns forever, subject to
his paying out of the same to my son James during his natural
life the yearly sum of seven Dollars, and also subject to his
Mothers interest therein as is herein after mentioned.
likewise subject to a Road herein after mentioned.
Item, I give to my Daughter-in-law, the Widow of my son Thomas
during her Widowhood, a living with her son Samuel in that part
of my land herein devised to him.
Item, I have laid out a road across my Land, which I order to be
opened and kept so for the Use and Convenience thereof, as
follows: viz, Beginning at the Walnut Tree in my yard, from
thence South thirty-three degrees West sixty-nine perches to the
Post mentioned in the Division Line, thence with said line South
fifty one degrees, West fifty eight Perches to the old Poplar,
thence across the land herein devised to my grand-son Samuel
south fifty-five degrees West ninety-seven perches to Thomas
SMITHs land about forty-four Perches to the Eastward of my
corner.
Item. I give and bequeath to my grandson Samuel McCLINTOCK the
son of my son Thomas my bed and Furniture whereon I now lay, and
my large Brass Kettle.
Item, I give to my Niece Rachel DEAN my Bed and furniture whereon
she now lays, and to my son Samuel, my Bed & furniture
standing upstairs in the front Room, and my large Pot; And to my
grand-son Samuel, the son of my son Thomas all my Silver Buttons,
and to my Grand-son Samuel, the son of my son John, all my Silver
Buckles.
Item, I give and bequeath to my son John McCLINTOCK all the
remaining Part of my Personal Estate both in Stock, outstanding
debts, cash, and every thing whatsoever and wheresoever, debts
and Legacies being first deducted as before directed, and paying
out of the same to his Brother, James McCLINTOCK, during his
natural life, the yearly sum of seven Dollars.
Lastly, I make choice of my son John McCLINTOCK to be my whole
and sole Executor of this my last Will and Testament, ratifying
and confirming this my last Will & Testament. In witness
whereof I have hereunto set my hand and seal the nineteenth Day
of April in the Year of our Lord One Thousand Eight Hundred and
Six.

County Before me personally appeared Jacob GRAVE and
Joseph CHANDLER, two of the subscribing witnesses to the above
and foregoing will who being duly affirmed did severally say that
they saw Samuel McCLINTOCK the Testator sign and seal the above
and foregoing Instrument of writing, and heard him publish,
pronounce, and declare the same, as and for his last Will and
Testament, that at the time of his so doing he was to the best of
their belief of sound and disposing mind and memory, that it was
at the request and in the presence of the said Testator and in
presence of each other they subscribed their names as witnesses
hereto, and at the same time saw Benjamin Chandler subscribe his
name in like manner as another witness thereto. In Testimony
whereof, I have hereunto set my hand the 2nd Day of October,
A.D.1806.
